This center contains the legal documents in force for OpenAX Technologies Pty Ltd and its products OpenAX, MojoAX and MojoClaw. The English version is the legally binding reference; Chinese is a convenience translation, and English prevails in case of conflict. These documents are governed by the laws of Victoria, Australia.
OpenAX Technologies Pty Ltd ("OpenAX", "we") handles personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what we collect, why, how we use, disclose, transfer cross-border, store, retain and delete it, and the rights you have and how to exercise them.
(a) Account data: email, display name, credentials, subscription and credit balance, device identifiers and status; (b) usage data: task types, credit usage, feature use, logs and diagnostics, IP and approximate location; (c) content you submit: chats, prompts, uploads and outputs; (d) billing data: collected by our third-party payment processor — we do not store full card numbers. MojoClaw is local-first and does not upload project source, .env, keys, browser cookies, terminal logs or screenshots by default.
We use personal information to provide and maintain the service, run agent tasks, bill and control quota, ensure security and prevent abuse, support customers, improve the product, and meet legal obligations. We do not use your private content to train any model unless you explicitly consent.
We disclose only what is necessary to subprocessors that operate the service (see Subprocessors) and may disclose to regulators or law enforcement where legally required. We do not sell your personal information.
Some processing may involve providers outside Australia (e.g. the United States). We apply contractual and technical safeguards to protect transferred data. Enterprise customers can choose a data-residency region (incl. Sydney, Australia).
We protect personal information using technical and organisational measures consistent with industry standards, including encryption in transit and at rest, access controls and authorisation management. Retention periods are determined by your chosen subscription tier (see each product's pricing), after which data is cleared; you may export or request deletion at any time. On account closure we delete or anonymise your personal information, except where retention is required by law.
Under the APPs you may access, correct, delete and export your personal information and withdraw consent. Email privacy@openax.au to exercise rights or complain; we respond within a reasonable time (generally 30 days). If unsatisfied, you may complain to the Office of the Australian Information Commissioner (OAIC, oaic.gov.au).
These Terms form a binding agreement between you and OpenAX Technologies Pty Ltd. Using OpenAX, MojoAX or MojoClaw means you accept them. They are governed by the laws of Victoria, Australia, and do not exclude or limit the non-excludable consumer guarantees under the Australian Consumer Law.
You must be at least 16 and able to form a contract; enterprise accounts are accepted by an authorized representative on behalf of the organization. You are responsible for account security and activity. Credits in one OpenAX account work across MojoAX and MojoClaw.
Subscriptions are billed monthly or annually with monthly included credits (no rollover); top-up packs are bought separately, valid 12 months from purchase and roll over. Tasks are charged per the published credit matrix; external premium models pass through at a public multiplier. Prices for Australian consumers include 10% GST.
Subscriptions renew automatically with clear prior notice. You may cancel anytime in your account, effective at the end of the current billing period; started periods are not separately refunded (except as required by law — see Refund Policy).
You must follow the Acceptable Use Policy. You retain rights to content you submit and grant us a limited license as needed to provide the service. You are responsible for the legality of content you submit and generate; high-risk professional outputs require human review (see AI Disclaimer).
IP in the OpenAX platform, software, brands and documentation belongs to OpenAX or its licensors. Subject to your compliance, you may use outputs you lawfully generate.
To the maximum extent permitted by law the service is provided "as is"; our aggregate liability is capped at the fees you paid in the 12 months before a claim. This does not affect statutory ACL guarantees. Disputes are subject to the courts of Victoria, Australia.
To keep all users and third parties safe, the following are prohibited when using OpenAX products:
Unlawful content; malware, exploits and attacks; circumventing security or quota controls; unauthorized access to others' systems, accounts or data; IP or privacy infringement; fraud, spam, hateful or harassing content; anything harmful to minors; and creating or spreading seriously misleading information.
Browser and desktop automation may only be used within the scope of your lawful authorization; high-risk actions require confirmation and are logged. It must not bypass CAPTCHAs/human verification, mass-scrape protected data, impersonate others, or perform unauthorized automation against third-party systems.
Report abuse to abuse@openax.au. Violations may lead to rate-limiting, suspension or termination; we cooperate with regulators and law enforcement as required by law.

This policy does not limit your statutory rights under the Australian Consumer Law: if a service has a "major failure" you may be entitled to a refund or other remedy. The following are commercial policies in addition to those rights.
Monthly subscriptions are generally non-refundable for used periods; annual subscriptions are fully refundable within 14 days of purchase if not materially used, otherwise assessed pro-rata for unused months. After cancellation you retain access until the period ends.
Monthly included credits are non-refundable and do not roll over; unconsumed purchased top-up credits may be refunded within 14 days of purchase if not materially used — consumed credits are not. Top-up packs are valid 12 months and expire thereafter.
Email billing@openax.au with your account and order details; we will respond within 5 business days.
OpenAX products generate content via AI agents and can perform actions. AI may produce inaccurate, incomplete or inappropriate results; verify before relying on them, especially for important decisions.
Generated legal, medical, financial, tax or engineering content is not professional advice and creates no professional relationship; critical decisions must be reviewed by licensed professionals. We provide human-review entry points and disclaimers for high-risk professional outputs.
When Mojo Use performs real browser/desktop actions, the process is visible and stoppable; high-risk actions require your explicit confirmation. You are responsible for the outcomes of automation you authorize.
You must ensure your use of generated content complies with applicable law and third-party rights (including copyright, privacy and platform rules).
In line with the new automated-decision transparency requirements under Australian privacy law, we disclose where substantial automated decisions are involved.
Account and subscription status, usage and credit data, device and risk/abuse signals may be used in automated processing such as credit deduction, quota control, risk control, content safety and personalization.
These decisions are mainly operational (e.g. credit deduction, rate-limiting, content-safety blocking). For decisions that could significantly affect your rights or interests, we provide an explanation and a human-review channel via privacy@openax.au.
To deliver the service we use the subprocessors below to process limited personal information. We disclose only what is necessary and require protection no lower than this policy.
Amazon Web Services (cloud hosting and storage, data-residency regions including Australia, plus transactional email); Cloudflare, Inc. (DNS, CDN, email routing and security); Google LLC (email and collaboration).
When you use relevant features, tasks may be routed to external model providers (e.g. Anthropic, OpenAI, Google). We do not use your private content to train their models unless you explicitly consent.
Subscription and credit payments are handled by a compliant third-party payment processor; we do not store full payment-card data.
Where enterprise customers use MojoAX to process their end-users' personal information, OpenAX acts as processor and the customer as controller. This DPA summarizes obligations; enterprises can request a signable version via legal@openax.au.
We process only on the customer's documented instructions; we apply encryption, access control, least privilege, audit logging and subprocessor management; we offer data-residency options and security-incident notification without undue delay after confirmation.
The customer authorizes the subprocessors listed in "Subprocessors"; we notify in advance of material new subprocessors, to which the customer may reasonably object.
We assist the customer in responding to data-subject requests; on termination we delete or return data per the customer's instruction and cease further processing, except where retention is required by law.
Target monthly availability 99.9% (higher available for Enterprise); planned maintenance is notified in advance and excluded from downtime.
Tiered response by severity (P1 critical prioritized); Enterprise receives a dedicated support channel and customer success manager.
